Trucking Companies Are Required to Perform Safety Inspections
The Federal Motor Carrier Safety Administration (FMCSA) regulations mandate that every motor carrier and intermodal equipment provider must systematically inspect, repair and maintain, or cause to be systematically inspected, repaired and maintained, all vehicles and equipment under its control. In addition, the transportation company must keep records of the maintenance inspections.
If a truck is found to be unsafe or in need of repairs, the FMCSA states that no one is permitted to operate any motor vehicle or intermodal equipment declared and marked "out-of-service" until all repairs required by the out-of-service notice have been satisfactorily completed. Records of the repairs must be kept by the trucking company.
We will investigate the cause of your accident and determine liability. If the trucking company failed to perform regular maintenance checks and make necessary repairs, we can hold it accountable for injuries or deaths caused by this negligence.
